The ongoing legal battle involving Do Kwon, the co-founder of Terraform Labs, sees another twist as the Appellate Court of Montenegro intervenes, overturning a previous decision to extradite Kwon to the United States.
On March 5, the Appellate Court of Montenegro declared the annulment of the High Court of Podgorica’s decision, which had approved Kwon’s extradition to the United States, as per an official statement.
The Appellate Court cited “significant violations of the provisions of criminal procedure” within the local laws, asserting that the prior order by the High Court in Podgorica was flawed.
In its statement, the panel highlighted the absence of clear and valid reasons supporting crucial facts concerning the extradition request.
Do Kwon’s Prolonged Legal Battle
This latest development adds to the protracted extradition process initiated when Kwon was arrested in Montenegro in March 2023. Both the United States and South Korea have sought Kwon’s extradition, sparking debates over his destination.
In December 2023, the Appellate Court of Montenegro nullified the extradition approval for Kwon, advocating for a retrial at the Podgorica Basic Court. Earlier, in November 2023, the High Court of Podgorica had established the legal prerequisites for Kwon’s extradition, deferring the final decision to the Montenegrin Minister of Justice.
